City of Haverhill January 25, 2005 Meeting of the City Council was held at 7:00 o’clock P.M.

Present - President Michitson, Councillors Ryan, Daly O’Brien, Fossarelli, Hart, Scatamacchia, Hall and Macek

Absent - Councillor DesMarais

Records of the two previous meeting were approved.

Councillor Macek was appointed to read the records for the present week.

Hearing was held on Document 2, a petition from Massachusetts Electric Company requesting a pole location on South Elm st.

Tighe representing applicant Jerry Piro requesting a special permit to Build Within the Watershed Protection District; three homes at the corner of Crystal st and Liberty st.

WITHDRAWN WITHOUT PREJUDICE Yeas 8, Absent 1

Hearing was held on Document 154, an application from Stephen Defeo for a Special Permit to build a cluster residential subdivision at 714 North Broadway; 14 new single family homes.

On motion of Councillor Daly O’Brien to amend the Special Permit to incorporate the Planning Director’s comments from his letter dated January 21, 2005 to comply with items 9, 10, 11 and 12 and to agree to comply with the proposed conditions and stipulations as stated in the letter and also, to incorporate the department head letters, the yeas and nays were as follows:

Yeas 8, Absent 1 and MOTION PASSED

On motion of Councillor Fossarelli to amend the Special Permit to reflect $15,000 flat fee donation in lieu of an affordable housing unit, the yeas and nays were as follows:

Yeas,-Councillors Daly O’Brien, Fossarelli and President Michitson 3, Nays,-Councillors Ryan, Hart, Scatamacchia, Hall and Macek 5 Absent,-Councillor DesMarais 1, and MOTION NOT PASSED

On motion of Councillor Ryan to pass with conditions, the yeas and nays were as follows:

Yeas 8, Absent 1, and MOTION PASSED and HEARING CLOSED and GRANTED WITH CONDITIONS

NEW BUSINESS

Councillor Macek introduced Document 21 To Wit:

MUNICIPAL ORDINANCE CHAPTER An Ordinance Relating To Vehicles Unregistered

Councillor Hall introduced Document 2-B An Order Granting:

Permission to Massachusetts Electric Company for a pole location on South Elm st. Located in the book of Location orders.

Councillor Ryan introduced Document 12-B To Wit:

ORDERED: That Document 12 shall be amended as follows: By deleting the words “send the proceeds from the sale to be used for equipment at St James School”.

On motion of Councillor Fossarelli that document be amended as follows: That the proceeds from the sale of obsolete surplus equipment go to the Special Olympics and that a letter be sent to the Mass Special Olympics, the yeas and nays were as follows:

Yeas 8, Absent 1, and MOTION PASSED

On the question of passage as amended, the yeas and nays were as follows:

Yeas 8, Absent 1, and PASSED AS AMENDED

Councillor Daly O’Brien introduced Document 159-B/04 To Wit:
