Meeting of the City Council was held at 7:00 o’clock P.M.

Present,-Councillors Ryan, Daly O’Brien, Fossarelli, Hart, DesMarais, Scatamacchia, Hall and Macek

Absent,-President Michitson

Records of the last meeting were approved.

Councillor Scatamacchia was appointed to read the records for the present week.

Communication was received from Councillor DesMarais requesting a discussion relative to Document 54-M, an Order to surplus & authorization of the Mayor for RFP for a portion of real property at 500 Primrose st.

HEARING

Hearing was held on Document 144, an application for a Special Permit from Attorney Richard Sheehan for Vincent O’Rorke to build 24 units in one building – residential condos at 8-88 River st; Assessor’s Map 501, Block 227, Lots 4 & 5. With Attorney Richard Sheehan and Morris Schopf appearing in favor and no one in opposition, the hearing was closed.

On motion of Councillor DesMarais that the document be amended to include all the items and conditions as stated in the letters from the City Departments along with all requirements for special permits and would be made part of the special permit project, the yeas and nays were as follows:

Yeas 8, Absent 1, and MOTION PASSED

On the question of granting with conditions, the yeas and nays were as follows:

Yeas 8, Absent 1, and HEARING CLOSED and GRANTED WITH CONDITIONS 144

On motion of Councillor Hall that the rules be suspended to grant permission that Santa Claus may land on the downtown parking deck by helicopter, the yeas and nays were as follows:

Yeas 8, Absent 1, and MOTION PASSED

On motion of Councillor Macek that permission be granted, the yeas and nays were as follows:

Yeas 8, Absent 1, and GRANTED 164

UNFINISHED BUSINESS

Document 54-M ORDERED: That a portion of real property located at 500 Primrose st, Assessor’s Map 649, Block 611, Lot 2, as detailed on the attached plan “Site Development Plan of Land in Haverhill, Massachusetts” prepared by Merrimack Engineering Services and dated December 16, 2002 revised March 26, 2003 is hereby declared surplus. Also, the Mayor is hereby authorized to issue a request for proposals for the lease of said premises.

On motion of Councillor Hart to amend the document as follows: By deleting the “.” after the word “premises” in the last sentence and inserting in place thereof “,” and then also by adding “for a term not to exceed four years with the final lease terms to come back to the City Council for approval.”, the yeas and nays were as follows:

On motion of Councillor DesMarais to restrict the license to Suburban Shuttle only and not do any business independent of the existing business of Suburban Shuttle, the yeas and nays were as follows:

On motion of Councillor DesMarais to grant license as amended, the yeas and nays were as follows:

NEW BUSINESS

Councillor Scatamacchia introduced Document 159 To Wit: ORDERED: That Document 172 of January 2, 1996 (An Order relating to rates for private snow plowing and hauling) be and is hereby deleted in its entirety and following inserted in place thereof:
