Meeting of the City Council was held at 7:00 o’clock P.M.

Present,-President Hart, Councillors Hall, Hetel, Swartz, Daly O’Brien, Scatamacchia, Macek, Ryan and Curtin

Councillor Daly O’Brien was appointed to read the records for the past and present weeks.

PETITIONS

Petition was received from Attorney James Waldron for Evans Property LLC, requesting a Zoning Change to amend the Zoning Map, Chapter 255-8, for property at Shelley rd & the Route 125 Connector from Industrial Park (IP) to Commercial Highway (CH) in Table 1: Table of Use & Parking Regulations; Assessor’s Map 762, Block 1, Lots 6 & 7.

Communication was received from Councillor Macek requesting a street light on Hilldale av in front of the former Marble Motors used car lot.

On motion of Councillor Macek to refer the document to the Wiring Inspector, the yeas and nays were as follows:

Communication was received from Councillor Macek requesting to present the Minutes and recommendations of the Natural Resources & Public Buildings Committee meeting that was held on January 19 th.

On motion of Councillor Macek to refer the document to the Mayor to send out the RFP, the yeas and nays were as follows:

Councillor Scatamacchia introduced Document 17-B To Wit: ORDERED: That the sum of $280,657 be transferred from Salary Reserves and placed in the following accounts: City Council, Mayor, Auditor, Purchasing, Assessor, Law, Treasurer & Collector, Human Resources, Information Technology, City Clerk, Conservation, Economic Development, Building Maintenance, Police (Reserve Clerks), Fire (Clerks), Building/ Zoning, Highway, Municipal Garage, Park, Health, Library, Vetreran’s, Council on Aging and Citizen Center. Councillor Macek introduced Document 23 To Wit: ORDERED: That an emergency be declared involving the health and safety of the public in accordance with Section 31D,Chapter 44, General Laws as amended, providing for payment in excess of appropriation for Snow & Ice Removal.

On motion of Councillor Curtin that the document be referred to a special subcommittee as set up by the City Council President, the yeas and nays were as follows:

Councillor Hall introduced Document 24-C To Wit: ORDERED: That the Mayor is hereby authorized to enter into and execute “Termination of Rights and Easements” agreement on behalf of City of Haverhill with BC Walnut Street LLC and BC Haverhill Lofts LLC relative to property at 13-17 Locust st and 16-18 and 38-42 Walnut st and 21-25 Locust st, 50-54 Locust st, Rear 56-62 Locust st and 33-43 Locke st.

On motion of Councillor Curtin that the document be referred to a special subcommittee as set up by the City Council President, the yeas and nays were as follows:

Councillor Swartz introduced Document 25 To Wit: P R O C L A M A T I O N WHEREAS Catholic Schools in the City of Haverhill, Massachusetts have made many contributions to advance the intellectual standard of its students; and WHEREAS the Catholic Schools serve as a shining example in the community of how to shape today’s students into tomorrow’s citizens; and WHEREAS the School’s students, teachers and staff are examples of leadership; and NOW THEREFORE I, JAMES J FIORENTINI, MAYOR of the City of Haverhill hereby proclaim the week of January 30 th through February 3 rd. CATHOLIC SCHOOLS WEEK IN HAVERHILLIN WITNESS WHEREOF I have hereunto set my hand and caused the Seal of the City of Haverhill to be affixed this 20 th day of January in the year of Our Lord two thousand and six.

On motion of Councillor Swartz to amend in the last paragraph by adding “,alumni” after the word “teachers”, the yeas and nays were as follows:
