Meeting of the City Council was held at 7:00 o’clock P.M.

Present,-President Hart, Councillors Hall, Hetel, Swartz, Daly O’Brien, Scatamacchia, Ryan, Macek and Curtin Records of the last meeting were approved.

Councillor Curtin was appointed to read the records for the present week.

PETITIONS

Application was received from the Amvets Ladies Auxiliary for Tag Days on Friday and Saturday September 15 th & 16 th.

Application was received for a Hawker/Peddler License from Douglas Greenlaw to sell hotdogs, chips, tonic and bottled water at the Bradford Common, Sunday–Saturday 9:00 AM to 9:00 PM.

HEARING (Required by M.G.L. Ch. 161)

Hearing was held on Document 30, a petition from Verizon New England and Mass Electric Co requesting a joint pole location on Boston Rd. With Robert Grassia appear in favor and William Copeland appearing in opposition the hearing was closed.

HEARINGS

Hearing was held on Document 19-B, petition from the City of Haverhill for a Zoning Change to Amend Article 12, Table 1 & Table 2 in Chapter 255, Parking requirements in the IG District.

Appearing in favor were Mayor James J. Fiorentini,William Pillsbury, Robert Harb, Frank Valdez, Michael Migliori, Brecht Palombo, Emily McCourt, and Steve DeSisto.With Daniel DesRoche, Jules Epstein, and Louis Fossarelli appearing in opposition the hearing was closed.

UNFINISHED BUSINESS

MUNICIPAL ORDINANCE CHAPTER An Ordinance Relating to Zoning Amend, Chapter 255, Parking Requirements Table 1 & 2 in the IG District The document will be amended as follows:

On motion of Councillor Macek to amend the 3 rd line, 2 nd paragraph – The notation will then read as follows: Delete 1.0 per residential unit and replace it with “1.0 parking space for Studios, 1.2 parking spaces per one bedroom units, 1.4 parking spaces per two bedroom units or more”, the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED

On motion of Councillor Macek: to add to the same paragraph, last line, the following language after the words IG District “located in the downtown. This ordinance shall not affect any other IG District and shall not affect the IG District located in the Bradford section of Haverhill”, the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED

On motion of Councillor Macek: in the 3 rd paragraph, at the end of the first sentence remove “Planning Board at the definitive stage” and insert in place thereof “Permit granting authority”, the yeas and nays were as follows:

Yeas,-Councillors Hall, Hetel, Daly O’Brien, Scatamacchia, Macek, Ryan, Curtin and President Hart 8, Nays,-Councillor Swartz 1, and MOTION PASSED

On motion of Councillor Macek: in the 3 rd paragraph, the 3 rd line, add the words “public or private” between the word any and parking facility and remove “owned or operated by the city of Haverhill or the Merrimack Valley Regional Transit Authority” and insert thereof the word “parking” before the word “facility” in the last line, the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED

On motion of Councillor Macek: in the 3 rd paragraph, the 3 rd line, before the word “lease” add “long term” after “lease”, add in ( ) parenthesis (10 years or longer)

MOTION WITHDRAWN and RESTATED to reflect “long term” before the word “lease”, the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED

On motion of Councillor Macek: in the 5 th paragraph, the 2 nd line, delete the words starting at “Planning Board” to the end of the paragraph and insert thereof “permit granting authority that a reduced parking requirement is warranted when taking into consideration:”, the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED

On motion of Councillor Macek: Page 2 Item 5 delete in its entirety “impact of the parking requirement on the physical environment of the affected lot or the adjacent lots including reduction in green space, destruction of existing dwelling units, or loss of pedestrian amenities along public ways; and”, the yeas and nays were as follows:

Yeas,-Councillors Daly O’Brien, Scatamacchia, Macek, Ryan, Curtin, and President Hart 6, Nays,-Councillors Hall, Hetel and Swartz 3, and MOTION PASSED

On motion of Councillor Macek: Page 2 Item 6 delete “Planning Board and City Council” and insert thereof “Permit granting authority”, the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED

On motion of Councillor Macek: Page 2 Article 12 Table 2 will further be amended by adding Note 19. delete “to reflect 1.0 parking space per residential unit in the IG District” and insert thereof “This notation shall read as follows: 1.0 parking space for Studios, 1.2 parking spaces for one bedroom units, 1.4 parking spaces for two bedroom units or more.”; add to same paragraph, last line, the following language after the words IG District “located in the downtown. This ordinance shall not affect any other IG District and shall not affect the IG District located in the Bradford section of Haverhill” and Further, in the next paragraph: remove “Planning Board at the definitive plan stage” and insert thereof the words “Permit granting authority”. Councillor Hall introduced Document 37 To Wit: Order that real property located at Rooms 3 and 311 of City Hall, 4 Summer st, Haverhill, being and are hereby declared surplus. An appraisal of the property shall be conducted and Mayor is hereby authorized to negotiate leases for said real property, which shall be brought back to the City Council for final approval. On the question of passage, the yeas and nays were as follows:
