Meeting of the City Council was held at 7:00 o’clock P.M.

Present,-President Hart, Councillors Hall, Hetel, Swartz, Daly O’Brien, Scatamacchia, Macek, Ryan and Curtin

Records of the last meeting were approved.

Councillor Ryan was appointed to read the records for the present week.

NEW BUSINESS

Councillor Curtin introduced Document 89-B To Wit: ORDERED: Whereas Forest City Residential Inc has been approved for a 305 unit project in downtown Haverhill under Chapter 40R, and Whereas the total project cost will be approximately 70 Million dollars, and;

Now therefore be it ordered that the building permit and water/wastewater fees for the Forest City 40R project at Essex/Locke and Duncan Street shall not exceed One-million, one hundred eighty thousand, two hundred thirty five dollars ($1,180,235.00).

On motion of Councillor Hall to adopt the amendment offered by Planning Director William Pillsbury on August 14 2007, to delete the original amount and substitute the following:

One-million, two-hundred eleven thousand, nine-hundred ninety-four dollars. ($1,211,994.00), the yeas and nays were as follows:

Yeas 9, Nays 0, and MOTION PASSED and On motion of Councillor Macek to further adopt amendment as follows:

“So long as such permits are applied for and paid for prior to the expiration date of FY09”, the yeas and nays were as follows:
