October 13, 2009 Meeting of the City Council was held at 7:00 o’clock P.M. Present,-President Hart, Councillors Scatamacchia, Ryan, Macek, Daly O’Brien, Hall, McGonagle, Donahue and Quimby. Councillor Macek was appointed to read the records for the
present week. PETITIONS Petition was received from Stephen Defeo requesting City accept Peyton Way as a public road. REFERRED TO PLANNING BOARD and Notice of Design Public Hearing was received from Mass Highway Department to discuss proposed reconstruction of a 2.2 mile section of South Main st from Boston rd to Middlesex av (Basiliere Bridge) and a 0.5 section of Salem st from South Main st to Peabody st in Haverhill to be held Tuesday, November 17th 7 pm, Room 301, City Hall. PLACED ON FILE 67-D Notice was received from SAGE Environmental & T-Mobile of a proposed wireless telecommunications installation at 75 Willow av & also submitting address where interested parties may submit written comments. PLACED ON FILE 103 Abatement report was received from Board of Assessors for month of September. PLACED ON FILE 12-J COMMUNICATIONS Communication was received from Councillor Scatamacchia requesting a discussion regarding Haverhill residents with cars registered out of state. HEARING Hearing was held on Document 95, application from Junior Torres for a Special Permit to allow a Used Car Dealership at 70 White st; Assessor’s Map 608 Block 484, Lots 1,3, & 4 for 50 spaces. With Junior Torres in favor and no one in opposition, the hearing was closed. Reports were included from City departments. HEARING CLOSED On motion of Councillor Scatamacchia to condition the permit that buildings 70 & 76 go together and no separate operation that would bring additional traffic to the area could be allowed in building 76 unless the petitioner comes back to the City Council for an amendment to this permit with the exclusion of the welding operation with the same owner as the
auto operation. The yeas and nays were as follows: Yeas,-Councillors Scatamacchia, Ryan, Macek, Daly O'Brien, Quimby, 5, Nays,-Councillors Hall, McGonagle, Donahue and Hart 4, and PASSED and On motion of Councillor Macek to amend the application to indicate 40 spaces for used cars. Yeas 9, Nays 0 and
PASSED On motion of Councillor Macek to move the application as amended. PASSED Yeas 9, Nays 0 and On motion of Councillor McGonagle to add the following amendments: Page 1 first paragraph by changing the letter "C" to "D" to read (CBD) and Page 3 paragraph 1 line 3 by adding the words "pager number, cell phone or similar device" and Page 5 fifth paragraph line 1 by adding"City" in front of the words "Parking Attendants". PASSED Yeas 9, Nays 0 and PASSED AS AMENDED Yeas 9, Nays 0 16-G Councillor Daly O'Brien submitted the minutes of the Public Safety Committee meeting that was held Oct. 7.
