The Board of Health, City of Haverhill, on February 3, 1987 in accordance with and under the authority granted by Section 31 of Chapter III of the Massachusetts General Laws, promulgated and adopted the following regulation:

REGULATION OF PRIVATE WATER SUPPLIES

1. WATER SYSTEMS INSTALLATION:

a. If a public water system is located within 200 feet of a proposed or existing dwelling or place of business, the applicant shall connect the individual lot to the public water system. If a public water system is not located within 200 feet the applicant may install a private onlot water system, provided it is constructed, maintained and operated in accordance with applicable laws.

b. DUPLEXES: In the case of a duplex served by one private well, each residence shall be provided with individual pumps, water storage tanks, and other related plumbing located within each residence. One common pump, water storage tank, or other related plumbing fixture shall not be permitted to service more than one residence.

II. REVIEW OF PLANS:

An application for Well and Pump permit shall be submitted to the Board of Health and must be accompanied by a plan of the proposed water system. The submitted plan must show as a minimum: The lot to be served, location of the proposed well, location of existing or proposed sewage disposal facilities within 100 feet of the well. The plan must be prepared by a professional engineer or other professional authorized by law to prepare such plans.

A fee of $100.00 shall accompany the application for Well and Pump Permit. The Health Officer or Board of Health shall act upon a completed application within seven (7) days from the date upon which such completed application is filed with the City of Haverhill Board of Health. Upon review and approval, the Well and Pump Permit will be mailed to the applicant.

III. PERMIT REQUIREMENTS:

No private water system shall be installed in the City of Haverhill without prior writtten approval from the Water Department.

No private water system shall be installed in the City of Haverhill without prior completion and filing of an Application for Well and Pump Permit with the Board of Health.

In accordance with M.G.L. 40:54, no building permit shall be issued for the construction of a building (Foundation Permit) which would necessitate the use of water therein unless a supply of water is available, therefore, either from a water system operated by a City, Town or District or from a well located on the land where the building is to be constructed, or from a water corporation or company. The applicant shall submit to the Board of Health the results of an analysis of the water supply, chemical and bacterial* from a certified laboratory, prior to notification of the Building Inspector by the Health Department that a safe and adequate water supply is available to serve the lot. The Water Well Completion Report shall also be submitted to the Board of Health at this time.

IV. CHEMICAL AND BACTERIAL ANALYSIS OF WATER/SITE INSPECTION:

Prior to issuance of a Certificate of Compliance by the Board of Health, and the Certificate of Use of Occupancy by the Building Inspector, a City Sanitary Inspector shall take a sample of the water from a tap in the building (kitchen tap where available), at least 24 hours after the disinfection procedure is completed, for chemical and biological testing. The applicant will be required to wait an additional week if an appointment is made with the Health Department for sampling before the disinfection procedure is completed. A site inspection of the water system will be conducted in conjunction with the appointment for water sampling.

V. CERTIFICATE OF COMPLIANCE:

A new private water system shall not be placed in service, nor shall new dwellings or buildings be occupied until the Board of Health has determined that safe and adequate water supply is available, and a Certificate of Compliance has been issued indicating that said water system has been located and installed in compliance with the terms of the permit and applicable law.

*Chemical and bacterial analysis to include: Coliform bacteria, pH, alkalinity, hardness, turbidity, color, flourides, nitrates, sodium, iron, maganese, and copper.
