The Board of Health of the City of Haverhill, in accordance with and under the authority granted by Section 31, Chapter III of the Massachusetts General Laws, promulgated and adopted the following regulation at its meeting on March 21, 1989 and amended at a public hearing held on April 18, 2000:

Stumps and woodwastes are not permitted to be buried within the City of Haverhill without prior written approval from the Board of Health, and a permit from the D.E.P. in accordance with M.G.L.Chapter 111, Section 150A and 150A 1/2 and the regulations promulgated thereunder (310 C.M.R. 16.00 and 310 C.M.R 19.000).

Each request for a woodwaste disposal site shall be reviewed on a case-by-case basis taking into account such factors as the size of the site, volume of material to be disposed of, plans for covering the woodwastes, possible effects on local water supplies and resources, proposed future land use, potential for fire hazard, and potential to cause nuisance conditions.

APPROVED WOODWASTE DISPOSAL SITES SHALL HAVE THE FOLLOWING CONDITIONS IN ADDITION TO ANY IMPOSED BY THE D.E.P.:

1. Limited to the burial of stumps and brush.

2. Disposal shall be a minimum of four (4) feet above groundwater and covered with a minimum of two (2) feet of soil.

3. Soil must be pitched so that surface water runs off of it, away from stumps.

4. The developer shall file a recorded plot plan showing the location of the burial with the Board of Health before Certificates of Occupancy are issued or before the order of conditions is certified.

5. A minimum distance of one-hundred (100) feet from any tributary or wetland is required, and five-hundred (500) feet from any main body of water.

6. The disposal site shall be inspected by an agent of the Board prior to burial and prior to filling.

THE BOARD OF HEALTH RESERVES THE RIGHT TO PLACE FURTHER CONDITIONS, IF NECESSARY, ON ANY APPROVED SITES.
