The Board of Health, City of Haverhill, in accordance with and under the authority granted by Chapter III, Section 128A, of the Massachusetts General Laws promulgated and adopted the following regulation at its meeting on July 23, 1991. This regulation is to become effective August 12, 1991.

No access shall be granted to a tanning device until the facility has been granted a license from the Board of Health. A license is good for one year from the date of issue;

The Board of Health shall inspect each tanning facility within 30 days of licensure and every 6 months thereafter;

The Board of Health may revoke a license for failure to comply with a written order after seven days. An appeal of the revocation is made to the Department of Public Health.

The fee for the original license shall be $25.00, with an annual renewal fee of $25.00.

A tanning facility must provide every customer a written statement of warning and post a notice in a conspicuous place in every area where a device is used.

The required poster is being developed and printed by the American Cancer Society. They will provide the posters both to local boards of health and to tanning facilities at no cost. To obtain copies of the posting you should send a written request to The American Cancer Society, Massachusetts Division, 247 Commonwealth Ave., Boston, MA 02116.

There shall be a knowledgeable operator present at all times to assist the customer and to provide sanitized protective eyewear and towels;

The tanning device will be protected so that the interior temperature does not exceed 100 degrees F., and the timer shall have an accuracy of plus or minus ten percent.

Persons fourteen years of age to seventeen years of age, inclusive shall not use a tanning device without the prior written consent of a parent or legal guardian.

No person under age 14 shall use a tanning device unless accompanied by parent.

Written reports of an injury or complaint of injury shall be sent to the Board of Health.

The Department of Public Health may promulgate regulations necessary for the implementation of this statute.

Violations are punishable by a fine of not less than $200 nor more than $2000.
