April 27, 1989 The Board of Health of the City of Haverhill, on April 25, 1978, in accordance with and under the authority granted by Section 31, of Chapter III of the Massachusetts General Laws, adopted the following regulation to become effective March 1, 1990 A. GENERAL PROHIBITIONS: 1. No person shall remove or transport garbage, offal, or other offensive substances through the streets of the City of Haverhill without first obtaining either a permit, a septage haulers permit, or a certificate of registration from the Board of Health (the "Board") of the City. (a) Permits - shall be issued to those persons collecting and transporting garbage, offal, or other offensive substances collected within the City of Haverhill through the streets of the city. (b) Septage Haulers Permits - shall be issued to those persons who pump or transport the contents of any part of an individual sewage disposal system. (c) Certificate of Registration - shall be issued to those persons transporting garbage, offal, or other offensive substances collected outside the City of Haverhill and transported through the city. 2. An application for a permit, septage haulers permit, or certificate of registration shall contain such information as set forth herein and as required by the Board, on forms supplied by the Board. 3. An application for a permit, septage haulers permit, or certificate of registration under this ordinance shall be filed with the Board at least thirty (30) days prior to the date the applicant proposes to commence transporting or collecting garbage, offal, or other offensive substances. An application fee shall be charged in accordance with a fee schedule established by the Board. 4. Persons transporting or collecting wastes pursuant to a contract or agreement shall be required to apply for a permit, septage haulers permit, or certificate of registration within sixty (60) days of the adoption of this ordinance. 5. The Board of Health shall designate appropriate routes for the transportation of garbage, offal, or other offensive substances to their appropriate disposal area. Persons transporting such substances shall follow the designated routes. These designated routes shall not apply to persons conducting door-to-door garbage collection within the City of Haverhill. 6. Permits and septage haulers permits issued to persons who collect garbage, offal, or other offensive substances in areas zoned for business, commercial, or industrial use shall not restrict the hours of the day when such may be collected. 7. Permits issued to persons who collect garbage, offal, septage, or other offensive substances in areas zoned residential shall require that such persons collect and transport garbage in these residential neighborhoods during hours designated by the Board. 8. Permits, septage haulers permits and certificates of registration are not transferable without the Board's approval. 9. All permits, septage haulers permits, and certificates of registration expire at the end of the calendar year in which they were issued, but may be renewed annually on application as herein provided. 10. All persons transporting or collecting garbage, offal, or other offensive substances shall keep a copy of their current permit, septage haulers permit, and/or certificate of registration, including a map of the routes designated by the Board pursuant to Section A-5 of this ordinance, in each vehicle listed on the permit or certificate at all times. B. SPECIFIC PROVISIONS: 1. Applications: (a) Applications for Permits shall contain the following information: I. The disposal destination of the substances transported or collected. II. The types and quantities of substances transported. III. License numbers of all vehicles which will transport or collect substances under the permit. IV. Collection routes and collection days for each route. (b) Applications for Certificates of Registration shall contain the following information: I. The disposal destination of the substance transported. II. The place of origination of the substances transported. III. The types and quantity of substances transported. IV. License numbers of all vehicles which will transport substances under the certificate of registration. (c) Applications for Septage Haulers Permits shall contain the following information: I. The site for disposal of the septage. II. License numbers of all vehicles transporting substances under the Septage Haulers Permit. III. Any information required pursuant to 310CMR Sec. 15.02, a copy of which is attached hereto as Exhibt A. C. ENFORCEMENT 1. All vehicles permitted to collect and transport garbage under this ordinance shall have a copy of their current permit, septage haulers permit, or certificate of registration in the vehicle at all times. Vehicle operators shall produce said permit or certificate on request of either a Health Agent or an Officer of the City Police Department. 2. Any person who violates any of the provisions set forth herein or in a permit or certificate of registration issued to them shall be fined not more than fifty dollars ($50.00) for each violation. D. EXEMPTIONS: 1. Motor vehicles owned by the Commonwealth or any of its political subdivisions and motor vehicles engaged under contract with the Commonwealth in the transportation of garbage or refuse shall be exempt from these provisions. However, the City may recommend to the Department of Public Works, in writing, an alternative route of travel for such motor vehicles to abate the noise or nuisance incident to such travel. |
